Málaga city holds the largest single stock of registered tourist accommodation in the province, heavily concentrated in the Centro Histórico, Soho, La Merced and the areas behind the Malagueta seafront. It is also the municipality with the most active planning intervention.
How registration works here
Registration is regional: the property is declared to the Registro de Turismo de Andalucía (RTA) under Decreto 28/2016, which issues the VUT reference. The town hall does not issue the VUT itself, but its planning and ordinance position determines whether the use is lawful at the address.
Current restrictions
Málaga has restricted new tourist-housing use in districts where the share of tourist homes exceeds the threshold set by its urban planning amendment, and requires an independent street entrance in much of the affected stock. The position is district-specific: an address a street away can be treated differently.
What to check before buying or letting
- Check the district and census section against the current municipal restriction map before committing.
- Confirm whether the unit has, or could ever have, an independent entrance from the street.
- Ask whether the VUT was registered before the restriction took effect and how that status transfers.
- Request written confirmation from the town hall rather than relying on the seller's account.

- Search results on this site use tourism-registration records currently available through our official public-data sources. Coverage varies by registration type and source availability: VUT (vivienda de uso turístico) records for Málaga province have high OpenRTA coverage, while apartamento turístico (A) and establecimiento hotelero (H) entries reflect only the published subset. A missing result does not necessarily mean a registration is invalid or unregistered — always check the official regional register as well.
