Holiday Rentals in Torremolinos: Start With the Andalucía VUT
Holiday rentals in Torremolinos sit within Andalucía's vivienda de uso turístico (VUT) framework.
Where the property falls within that regime, the tourism-registration side is handled through the Registro de Turismo de Andalucía.
However, an RTA registration should not be viewed as a complete planning or legal approval.
Andalucía's current rules require viviendas de uso turístico to comply with applicable municipal urban-planning requirements.
For an owner or prospective buyer in Torremolinos, the investigation should therefore consider several separate issues:
- RTA/VUT registration
- municipal planning status
- registration history
- community of owners restrictions
- authorised guest capacity
- property documentation
- operator details
- guest-registration requirements

Torremolinos Has a Long History of Tourist Apartments
Torremolinos developed as one of the Costa del Sol's major tourism centres, and apartment buildings designed around holiday and seasonal occupation form a significant part of its built environment.
Areas such as:
- La Carihuela
- Bajondillo
- Playamar
- Los Álamos
- Montemar
- El Pinillo
- the town centre
contain very different forms of residential and tourist accommodation.
Some buildings have a long history of short-stay accommodation while others are primarily conventional residential communities.
That history can be useful context, but it should not replace property-specific checks.
The fact that apartments in the same building have historically been holiday-let does not automatically establish the position of a particular unit today.

The 2020 Planning Framework Was Annulled
One of the most important local planning issues in Torremolinos is the history of its PGOU.
The municipality had adopted a newer planning framework in 2020, but that plan was subsequently annulled following court proceedings.
As a consequence, Torremolinos reverted to its earlier 1996 PGOU.
Planea Torremolinos itself explains that this older plan no longer reflects the municipality's current socioeconomic reality, present environmental requirements or Andalucía's modern urban-planning framework.
This is why the Town Hall is now preparing new planning instruments.
For buyers, the practical lesson is that the planning history of the municipality is unusually important.
Do not assume that planning information taken from an old property brochure, estate-agent description or historic planning search necessarily reflects the current operative framework. Torremolinos Is Preparing a New PGOM and POU
The Town Hall is developing two new planning instruments.
PGOM — Plan General de Ordenación Municipal
This establishes the broader municipal model and strategic land-use framework. Its advance was published in July 2025, with the public-consultation period later extended.
POU — Plan de Ordenación Urbana
This deals with detailed planning of existing urban land, including the urban fabric, public spaces, uses and regeneration.
The advance of the POU was published in December 2025 as part of the planning process.
Torremolinos has stated that the new framework is intended to respond to issues including:
- urban regeneration
- rehabilitation of existing buildings
- sustainability
- mobility
- housing
- public space
- environmental considerations
- modernisation of the existing urban fabric
An advance document does not itself create new binding VUT restrictions. The planning process is nevertheless relevant, because future rules affecting the compatibility of residential and tourist accommodation can emerge through municipal planning.
Has Torremolinos Banned New Holiday Rentals?
As of this guide's August 2026 review, we have not identified a current official Torremolinos Town Hall planning instrument establishing a municipality-wide blanket suspension of new viviendas de uso turístico comparable with Málaga city's current restrictions.
We have also not identified a confirmed Fuengirola-style municipal rule requiring every new VUT to have an independent entrance.
That does not mean every Torremolinos property automatically qualifies for holiday-rental use.
The property must still satisfy:
- Andalucía's VUT requirements
- applicable Torremolinos planning rules
- community of owners requirements
- property-specific planning and occupation requirements
Torremolinos' planning framework is also actively being rewritten.
Check the Planning Position of the Individual Property
The municipal planning position can matter even where neighbouring apartments operate successfully as holiday rentals.
For a Torremolinos property, investigate further where:
- occupation documentation is incomplete
- significant alterations have been carried out
- terraces or balconies have been enclosed
- rooms have been added or reconfigured
- the physical layout differs from plans
- commercial premises have been converted
- the building has an unusual planning history
- the property is older and documentation is limited
None of these automatically prevents VUT use. They are simply reasons to obtain further planning information — through the Torremolinos electronic office (opens in a new tab) or the Town Hall's Urbanismo service.
An Existing VUT Registration Should Still Be Verified
Where a Torremolinos property is advertised as already having a tourist registration, compare the registration with the property itself.
Check:
- VUT/RTA number
- exact address
- accommodation type
- authorised guest capacity
- operator information where available
- registration history

Registration History Can Matter
For an established holiday rental, the date on which tourist activity began can be important.
The legal and planning environment applying when an existing VUT commenced may differ from the position facing an owner attempting to begin a new activity today.
A buyer should therefore try to establish:
- original registration date
- continuity of tourist use
- operator history
- whether the property has been removed and re-entered in the tourism register
- whether municipal planning issues have arisen
- whether community approval requirements apply
Do not assume that an old VUT number automatically creates a permanent or transferable right.
Community of Owners Rules Are Especially Relevant in Torremolinos
Torremolinos contains a large number of apartment buildings and residential developments.
That makes the community of owners a central part of the due-diligence process.
Before purchasing, investigate:
- community statutes
- constitutive title where relevant
- meeting minutes
- resolutions concerning tourist accommodation
- rules governing noise or communal areas
- any community approval required for tourist activity

Community Approval Since April 2025
Changes to Spain's Horizontal Property Law took effect on 3 April 2025.
Where the amended provisions apply, an owner wishing to commence tourist-rental activity generally requires prior express approval from the community of owners using the statutory three-fifths threshold.
Different transitional considerations can apply to activities already lawfully operating.
This makes the history of an existing Torremolinos VUT especially relevant to somebody buying a property with an established holiday-rental business.
Older Tourist Buildings Need Careful Investigation
Torremolinos contains many buildings developed during the rapid tourism expansion of the Costa del Sol.
Some have historically combined:
- permanent residential occupation
- seasonal accommodation
- tourist apartments
- commercial units
- hotel-style uses
A building's historic association with tourism should not automatically be treated as proof that every individual unit today qualifies for VUT use.
Prospective buyers should establish:
- the actual legal use of the unit
- property documentation
- community documentation
- current tourism registration
- municipal planning position
La Carihuela, Playamar and Los Álamos Can Have Different Property Characteristics
Torremolinos' main coastal districts contain very different property types.
La Carihuela
Contains traditional properties, apartment buildings and tourist accommodation close to the beachfront.
Playamar
Includes substantial apartment developments and larger residential communities.
Los Álamos
Contains newer developments as well as established tourism and residential uses.
Central Torremolinos
Includes older apartment blocks, mixed-use buildings and significant regeneration areas.
Identifying these areas is not to suggest that each has different VUT laws. The point is that the type of property, building and planning history can vary considerably, which makes property-specific checks important.
Andalucía Property Standards Still Apply
Where a Torremolinos property can lawfully operate as a VUT, Andalucía's wider requirements continue to apply.
These include rules concerning:
- floor area
- authorised capacity
- bedrooms
- beds
- bathroom provision
- ventilation
- heating
- cooling
- kitchen facilities
- linen
- guest equipment
- waste arrangements
- smoke detection
- fire extinguishing equipment
- complaints procedures
- guest information
- operator contact arrangements

Guest Registration Is Separate From the Tourist Licence
An operating Torremolinos VUT is also subject to applicable national guest-information reporting obligations.
These operate separately from:
- the RTA registration
- Torremolinos planning
- community rules
Owners should have the appropriate guest-information collection and reporting procedure in place before accepting bookings.
Buying a Torremolinos Property With an Existing VUT
A property with an established VUT can be attractive where holiday-rental income is part of the purchase decision.
But it should still be investigated carefully.
Before purchasing, check:
- whether the VUT registration genuinely corresponds with the property
- registration date and history
- authorised capacity
- current operator
- current Torremolinos planning position
- physical property documentation
- community statutes
- community resolutions
- community approval position
- implications of changing owner or operator

Don't Apply Málaga, Fuengirola or Benalmádena Rules to Torremolinos
Municipal VUT rules differ across the Costa del Sol.
Málaga city has introduced broad planning restrictions affecting new tourist accommodation. Fuengirola applies a specific local planning restriction affecting certain new VUTs. Benalmádena has carried out detailed district-level studies and made recommendations concerning tourist-rental density.
Those measures should not automatically be applied to Torremolinos.
Likewise, a future Torremolinos planning measure would not automatically apply in the neighbouring municipalities.
Always establish which town hall controls the exact property.
