Holiday Rentals Are a Major Part of Benalmádena's Housing Market
Holiday accommodation has long been part of Benalmádena's tourism economy, but the scale of viviendas de uso turístico has increasingly become a housing and planning issue as well.
A Town Hall study published in February 2026 counted 8,209 registered tourist properties as at October 2025, representing approximately 17% of the municipality's housing stock.
The council divided the municipality into three broad districts:
- Benalmádena Pueblo – Capellanía
- Arroyo de la Miel – Santangelo – Montealto
- Benalmádena Costa
The study found that the coastal district contained approximately 85% of the registered tourist accommodation.
This means the local picture can vary substantially depending on exactly where a property is located.

Only Around Half of Registered Tourist Homes Were Actually Active
One particularly interesting finding from Benalmádena's study was the difference between the tourism register and the accommodation actually being marketed.
The Town Hall said its analysis of specialised holiday-rental platforms indicated that only approximately 50% of the 8,209 registered tourist homes were actively being commercialised.
This is an important distinction for Spain Rental Licence Check.
A property being present in an official tourism register does not necessarily mean that it is currently being operated as a holiday rental.
Equally, registration statistics should not automatically be interpreted as the number of active Airbnb or Booking.com listings.

The Coastal District Has the Greatest Holiday-Rental Pressure
The council's housing study found strong geographical differences.
Approximately 85% of registered tourist homes were concentrated in Benalmádena Costa.
This reflects the very different nature of the municipality.
Coastal areas include substantial apartment developments and buildings historically designed around tourism and short-stay accommodation, while Benalmádena Pueblo and Arroyo de la Miel contain a different mix of permanent residential property.
This geographical difference is important for buyers because the future municipal approach may not necessarily be identical across every part of Benalmádena. The Town Hall has analysed the municipality on a district-by-district basis; that analysis is not in itself a decision to zone or restrict any particular area.
What About the Recommended VUT Percentages?
The February 2026 housing study included recommendations concerning what it considered appropriate levels of tourist accommodation in the municipality's three districts.
The official Town Hall article reported:

These figures came from the housing study's recommendations.
As of this guide's review, we have not identified an official municipal planning instrument showing that these percentages have automatically become binding caps on new VUT registrations.
The Town Hall said it was examining the report and preparing a range of short-, medium- and long-term housing measures.
Owners and buyers should therefore check whether those recommendations have subsequently led to formal planning restrictions.
Benalmádena Had Already Mapped Tourist-Rental Pressure in 2024
This was not the municipality's first examination of holiday-rental concentration.
In September 2024 Benalmádena Town Hall reported that Urbanismo and Vivienda had created a detailed map comparing tourism-register data with the total housing stock in individual planning areas.
At that time the council identified particularly high concentrations around:
- Puerto Deportivo
- Benalbeach
- some buildings around Avenida Gamonal
- parts of Benalmádena Costa
The Town Hall reported lower levels in much of Arroyo de la Miel and Benalmádena Pueblo.
The council stated at the time that it intended to work with the University of Málaga to establish what limitations might be appropriate for the areas being studied. Those proposed limitations should not be treated as having automatically entered into force.

Check the Current Municipal Position Before Buying
Because Benalmádena is actively assessing the relationship between tourist accommodation and housing supply, prospective buyers should not rely on an old article or simply assume that the rules have remained unchanged.
Where holiday-rental use is important to a purchase decision, check:
- the current Benalmádena planning position
- whether any district-level restriction has subsequently been introduced
- the tourism registration
- registration date and history
- authorised capacity
- community rules
- the current operator
- whether the physical property corresponds with its documentation

Benalmádena Has a Municipal Procedure for Some Older Properties
Benalmádena's electronic office publishes an occupation-licence procedure covering an existing older dwelling that lacks an occupation licence and requires one in connection with tourist use.
This does not mean that every VUT owner needs that specific licence. The procedure is aimed at particular existing properties without an occupation licence, and it references the historic implementation of Andalucía's VUT regime.
For an older Benalmádena property with incomplete occupation documentation, the existence of this municipal procedure shows why the property's planning and occupation status can require separate investigation.

Benalmádena's Different Property Areas Require Different Due Diligence
Benalmádena includes several distinct property markets.
Benalmádena Costa
Contains large numbers of apartments and developments associated with tourism, including areas around the marina and beachfront.
Arroyo de la Miel
Has a stronger permanent residential character alongside tourist properties and apartment developments.
Benalmádena Pueblo
Includes traditional homes, villas, newer developments and properties where planning or heritage questions can differ considerably from coastal apartments.
The same VUT investigation should not simply be applied mechanically to every property.
Buildings Such as Benalbeach Illustrate Why Property History Matters
The Town Hall specifically identified the Benalbeach area as one of the municipality's highest concentrations of tourist accommodation in its 2024 analysis.
High existing holiday-rental activity within a building or development does not necessarily mean a purchaser should skip due diligence.
A buyer should still investigate:
- the individual unit's VUT registration
- registration history
- community statutes
- meeting resolutions
- authorised capacity
- operator details
- any current municipal restriction
Community of Owners Rules Are Particularly Important
Much of Benalmádena's tourist accommodation consists of apartments within communities of owners.
The fact that dozens of apartments in a development are offered for holiday rental does not automatically mean a new purchaser can commence tourist activity.
Check:
- community statutes
- constitutive title where relevant
- meeting minutes
- resolutions regarding tourist accommodation
- noise and communal-facility rules
- any required community approval

Community Approval Since April 2025
Changes to Spain's Horizontal Property Law became effective on 3 April 2025.
Where the amended provisions apply, owners wishing to commence tourist-rental activity generally require prior express approval from the community of owners using the statutory three-fifths threshold.
Existing lawful tourist activities can raise different transitional considerations.
This means that registration history can be especially important when buying an existing Benalmádena VUT.
An Existing VUT Still Needs to Be Verified
Where a property is advertised as already having a tourist licence, compare the registration with the actual property.
Check:
- registration number
- exact address
- registered accommodation type
- authorised capacity
- operator information where available
- registration history

Andalucía Property Standards Still Apply
Where a Benalmádena property can lawfully operate as a VUT, Andalucía's wider requirements remain relevant.
These include standards covering:
- floor area
- guest capacity
- bedrooms
- bathrooms
- ventilation
- heating and cooling
- kitchen facilities
- linen
- guest equipment
- smoke detection
- fire extinguishing equipment
- complaints procedures
- guest information
- operator contact arrangements

Buying a Benalmádena Property With an Existing Tourist Licence
An existing VUT can be attractive to buyers, particularly if the Town Hall introduces tighter controls in the future. That is not a reason to assume such a licence will become more valuable or automatically remain transferable.
Before purchasing, investigate:
- registration validity
- registration date and history
- authorised capacity
- operator details
- the Benalmádena planning position
- the district/local policy position
- occupation and planning documentation
- community statutes and resolutions
- community approval requirements
- implications of changing owner or operator
Holiday-rental income should not be relied upon until the property-specific position has been investigated.

Don't Confuse Benalmádena With Fuengirola or Málaga City
Municipal boundaries matter.
Fuengirola applies a specific local planning restriction affecting some new tourist homes. Málaga city has introduced broader planning restrictions affecting new tourist accommodation.
Those rules should not automatically be applied to Benalmádena.
Likewise, recommendations in Benalmádena's housing study should not automatically be applied to neighbouring municipalities.
