Holiday Rentals in Nerja: The Starting Point
Holiday rentals in Nerja operate within Andalucía's vivienda de uso turístico (VUT) framework, set out in Decreto 28/2016 and subsequently modified, including by Decreto 31/2024.
Properties falling within that regime are registered through the Registro de Turismo de Andalucía, but the regional registration should not be viewed as a substitute for checking the property itself.
Andalucía's regulations require tourist homes to comply with applicable municipal urban-planning rules, which makes the Nerja planning position an important part of the investigation.
For somebody buying specifically to generate holiday-rental income, the safest approach is to separate the question into several checks:
- tourism registration
- municipal planning
- environmental qualification, where the activity requires it
- community of owners
- property standards
- authorised capacity
- operator details
- guest-registration requirements
A registration number answers only part of that picture.
A Compact Municipality With a Concentrated Rental Market
Nerja is smaller and more compact than the western Costa del Sol towns, and much of its visitor accommodation sits close to the Balcón de Europa, the Burriana and Torrecilla beaches and the hillside developments above the town.
That concentration is one reason the relationship between tourist letting and local housing has become a live municipal topic, and why property-specific checks matter more than generalisations about “the Costa del Sol”.
An apartment inside a large managed community raises different planning and community questions from a townhouse in the old centre or a villa on the road to Maro and the Sierra de Almijara.

The New PGOM Is the Biggest Local Variable
Nerja's general plan was approved in 2000 and adapted to the LOUA in 2011. Following the 2021 Andalucían planning law (LISTA), the municipality is preparing a new Plan General de Ordenación Municipal, drafted with the Diputación de Málaga.
A citizen-participation stage opened on 1 June 2026 through a suggestions inbox on the municipal website, in advance of the Avance document being approved.
A new general plan can affect land classification, permitted uses and how the municipality treats tourist accommodation. It does not change the Andalucía VUT rules, but it can change the planning framework a specific property sits in.
Anyone buying in Nerja with holiday-rental income in mind should check the current stage of the PGOM and whether any proposal affects the property or its neighbourhood.

Calificación Ambiental: A Nerja Detail Worth Knowing
Nerja publishes its calificación ambiental resolutions — the municipal environmental-qualification decisions that apply to certain classified activities.
Those published resolutions have included decisions on tourist-apartment activities, and they have not all been favourable: the municipality has published unfavourable resolutions as well as favourable ones for tourist-apartment proposals in local urbanisations.
Whether this procedure applies depends on the activity in question rather than on the existence of a VUT number, so the right step is to establish with the Town Hall what the intended use requires for the specific property.
This matters most where a buyer is considering multiple units in one building, a conversion, or a property in a development where similar applications have already been decided.

Check the Urban-Planning Position of the Property
Because Andalucía requires tourist homes to comply with applicable municipal planning requirements, the planning status of the individual property is not a technicality — it is part of whether tourist use can properly be relied upon.
Owners or prospective buyers who are uncertain about a property's urban-planning status should verify the current position directly with Nerja Urbanismo.
This is especially important where:
- documentation is incomplete
- the property is older or was built before the current plan
- alterations, extensions or terrace enclosures have been carried out
- the property lacks clear first-occupation/habitability documentation
- there are questions over planning regularity
- the property sits in a development with a complicated planning history
- the property is close to protected coastal or natural areas
None of these automatically prevents a VUT. They are reasons to investigate further before relying on holiday-rental use.
A VUT Registration Should Match the Actual Property
When checking an existing Nerja holiday rental, compare the tourism registration with the property being advertised or sold.
Check:
- the registration number
- property address
- operator or registered party
- authorised guest capacity
- accommodation type
- relevant registration history

Community of Owners Checks in Nerja Urbanisations
A substantial part of the Nerja market consists of apartments and townhouses within urbanisations and communities of owners, many of them long established and managed for seasonal occupancy.
Buyers should obtain and review:
- community statutes
- constitutive title where relevant
- recent meeting minutes
- resolutions concerning tourist rentals
- rules relating to noise, pools and communal facilities
- evidence of any community approval required for tourist activity
Do not rely solely on statements such as “Other apartments here are on Airbnb.” Different properties in the same development may have different histories.

Community Approval Since April 2025
National changes to Spain's Horizontal Property Law took effect on 3 April 2025.
Where the law applies, an owner wishing to commence tourist-rental activity will generally need prior express approval from the community of owners, requiring the statutory three-fifths threshold.
Different considerations can apply to properties that were already lawfully carrying out the activity before the change, which makes the history of an existing Nerja VUT especially important for buyers.
Andalucía Property Standards Still Apply in Nerja
Where a property operates as a vivienda de uso turístico, the applicable Andalucía requirements can cover matters including:
- minimum floor area
- permitted capacity
- bedrooms and beds
- bathroom provision
- ventilation and window screening
- cooling and heating
- kitchen equipment and guest facilities
- linen and waste facilities
- smoke detection and fire-extinguishing equipment
- complaint forms and guest information
- operator contact arrangements

Maro, Rural Properties and Protected Surroundings
The municipality extends beyond the town itself to Maro and countryside rising towards the Sierra de Almijara, close to protected natural and coastal areas.
Do not assume that every countryside villa advertised to tourists falls under exactly the same regime as a conventional VUT on urban residential land. Depending on location and characteristics, different tourism or planning categories can become relevant, including rules applying to rural tourist accommodation.
Anyone purchasing a rural Nerja property for holiday-rental use should establish:
- land classification
- planning status
- lawful residential use
- tourism category
- access, water and infrastructure position
- whether any environmental or coastal protection affects the plot

Guest Registration Is Separate From the VUT
As elsewhere in Andalucía, an operating Nerja holiday rental is subject to the applicable national guest-information reporting regime, which operates separately from the tourism-registration and municipal planning position.
The owner or operator should have the required guest-information collection and reporting procedure in place before accepting bookings.
Buying a Nerja Property With an Existing Tourist Licence
A property marketed as having an existing tourist licence can be attractive, but the registration number should trigger further due diligence. Before purchasing, establish:
- whether the VUT registration genuinely relates to that property
- when the tourist activity began
- who is currently registered as the operator
- authorised guest capacity
- municipal planning status and any environmental-qualification requirement
- whether there are unresolved planning issues
- community statutes, resolutions and approval position
- whether the physical property corresponds with the documentation
- implications of changing owner or operator
- anything in the emerging PGOM that could affect the property
Where holiday-rental income is essential to the purchase, these questions should ideally be resolved before entering into a binding purchase agreement.
Don't Assume the Rules Are the Same as Málaga City or Marbella
Nerja, Marbella and Málaga are separate municipalities and their local planning measures should not be confused. Málaga city has introduced substantial municipality-specific restrictions affecting new tourist accommodation; as of this guide's August 2026 review we have not identified an equivalent Nerja-wide suspension from current official sources.
