
A VUT Number Is Only the Starting Point in Marbella
Marbella is one of Andalucía's most established holiday-rental markets, and a large number of its apartments, townhouses and villas are recorded in the regional tourism register as viviendas de uso turístico.
Because registration is a regional process, it tells you that a property has been declared to the Junta de Andalucía. It does not tell you whether the property satisfies Marbella's municipal planning position, whether the community of owners permits tourist accommodation, whether the authorised capacity matches the advert, or whether the operator named in the register is the person actually letting the property.
For a market as scrutinised as Marbella's, the practical approach is to treat a registration number as the beginning of the investigation.

Marbella's Municipal Planning Position
Andalucía's rules require viviendas de uso turístico to comply with applicable municipal urban-planning rules, and allow municipalities, where legally justified, to establish proportionate limits affecting tourist accommodation in particular buildings, sectors, areas, periods or zones.
That makes the town hall a separate line of enquiry from the regional register. In Marbella, the questions worth asking concern the authorised use of the specific property, whether the building or zone is affected by any restriction, and whether any municipal instrument affecting tourist accommodation has been finally approved rather than merely announced.
Because Marbella's framework is being reviewed, a check carried out a year ago should not be assumed to reflect the current position.
Converting Commercial Premises
Converting a shop, office or other commercial unit into holiday accommodation is a planning and building-use question decided at municipal level, and Marbella has indicated that it is working on rules in this area.
An owner considering such a conversion, or a buyer looking at a property that appears to have been converted, should confirm the authorised use directly with the council rather than relying on the existence of a tourism registration.
Community of Owners Restrictions
A very large share of Marbella's rental stock sits inside apartment blocks and gated urbanisations, which makes the community of owners position particularly important.
Andalucía's VUT framework recognises express prohibitions contained in the constitutive title or community statutes. Separately, national Horizontal Property Law provisions became important from 3 April 2025: owners wishing to commence tourist-rental activity after that date will generally require prior express approval from the community, with different considerations where the activity was already lawfully being carried out.
Before relying on holiday-rental use, obtain and read:
- the constitutive title and community statutes
- recent minutes and community resolutions
- evidence of when the tourist activity began
- confirmation of who is registered as the operator

Property Standards and Safety
Andalucía's requirements for viviendas de uso turístico cover capacity, floor area, ventilation, cooling and heating, bathrooms, beds, kitchen equipment and guest information, as well as safety items including a smoke detector and a fire extinguisher.
Marbella properties are often well presented, but presentation is not the same as compliance. The advertised capacity in particular should be checked against what the property is authorised to accommodate.
Guest Registration Is a Separate National Obligation
Accommodation providers across Spain are subject to national guest-information obligations that operate independently of the Andalucían tourism register. An owner letting in Marbella needs a working procedure for collecting and communicating the required guest and booking information before accepting bookings.
The national short-term rental registration framework introduced by Royal Decree 1312/2024 should also be checked against current official information, because important provisions of that Royal Decree were annulled by Supreme Court judgments during 2026 and older explanations may now be incomplete.
Buying a Marbella Property for Holiday Rental
Where holiday-rental potential is part of the reason for buying, treat it as a series of separate checks carried out before signing a binding agreement:
- confirm the registration exists and matches the property being sold
- establish the authorised guest capacity
- identify the currently registered operator
- obtain the community statutes and relevant resolutions
- establish when the tourist activity commenced
- check Marbella's current municipal planning position for the property
- establish whether the activity can continue after the purchase
Descriptions such as “tourist licence included” or “ideal for Airbnb” are marketing statements, not verification.
