Holiday Rentals in Estepona: The Starting Point
Holiday rentals in Estepona operate within Andalucía's vivienda de uso turístico (VUT) framework.
Properties falling within that regime are registered through the Registro de Turismo de Andalucía, but the regional registration should not be viewed as a substitute for checking the property itself.
Andalucía's regulations require tourist homes to comply with applicable municipal urban-planning rules, which makes the Estepona planning position an important part of the investigation.
For somebody buying specifically to generate holiday-rental income, the safest approach is to separate the question into several checks:
- tourism registration
- municipal planning
- community of owners
- property standards
- authorised capacity
- operator details
- guest-registration requirements
A registration number answers only part of that picture.
Estepona Has a Long-Established Tourist-Rental Market
Holiday letting is not a new phenomenon in Estepona.
The municipality combines a restored historic centre with a substantial stock of apartments, townhouses and villas built around the Costa del Sol's residential-tourism market, and the Junta de Andalucía formally recognised the scale of that activity when it declared Estepona a tourist municipality.
The old town has a different built environment from the seafront apartment blocks, while areas such as Cancelada, Selwo, El Paraíso, Atalaya, Bahía Dorada and the New Golden Mile contain extensive urbanisations where holiday letting has long been common.
That variation is one reason property-specific checks matter.
An apartment within a large coastal community can raise different planning and community questions from a townhouse in the old town or a detached villa on a golf development.

Check the Urban-Planning Position of the Property
Estepona Town Hall's Urbanismo department deals with the planning, licensing and habitability position of properties in the municipality.
Because Andalucía requires tourist homes to comply with applicable municipal planning requirements, the planning status of the individual property is not a technicality — it is part of whether tourist use can properly be relied upon.
Owners or prospective buyers who are uncertain about a property's urban-planning status should verify the current position directly with Estepona Urbanismo.
This is especially important where:
- documentation is incomplete
- the property is older
- alterations have been carried out
- extensions or terraces have been enclosed
- the property lacks clear first-occupation/habitability documentation
- there are questions over planning regularity
- the property is located in a development with a complicated planning history
None of these automatically prevents a VUT. They are reasons to investigate further before relying on holiday-rental use.

A VUT Registration Should Match the Actual Property
When checking an existing Estepona holiday rental, compare the tourism registration with the property being advertised or sold.
Check:
- the registration number
- property address
- operator or registered party
- authorised guest capacity
- accommodation type
- relevant registration history
Where information appears inconsistent, investigate before relying on the licence for a purchase or investment decision.

Estepona Urbanisations Make Community Checks Especially Important
A substantial part of the Estepona property market consists of apartments, townhouses and villas within residential urbanisations and communities of owners.
For these properties, the community of owners can be just as important as the tourism registration.
Buyers should obtain and review:
- community statutes
- constitutive title where relevant
- recent meeting minutes
- resolutions concerning tourist rentals
- any rules relating to noise or communal facilities
- evidence of any community approval required for tourist activity
Do not rely solely on statements such as “Other apartments here are on Airbnb.” Different properties in the same development may have different histories.

Community Approval Since April 2025
National changes to Spain's Horizontal Property Law took effect on 3 April 2025.
Where the law applies, an owner wishing to commence tourist-rental activity will generally need prior express approval from the community of owners, requiring the statutory three-fifths threshold.
Different considerations can apply to properties that were already lawfully carrying out the activity before the change.
This makes the history of an existing Estepona VUT especially important for buyers. Check when the tourist activity began and what documentary evidence exists rather than assuming that an existing registration gives a new purchaser an unrestricted right to continue operating it.
Andalucía Property Standards Still Apply in Estepona
Estepona does not sit outside the wider Andalucía VUT regime.
Where a property operates as a vivienda de uso turístico, the applicable Andalucía requirements can cover matters including:
- minimum floor area
- permitted capacity
- bedrooms and beds
- bathroom provision
- ventilation
- window screening
- cooling
- heating
- kitchen equipment
- guest facilities
- linen
- waste facilities
- smoke detection
- fire-extinguishing equipment
- complaint forms
- guest information
- operator contact arrangements

Old-Town and Older Properties Need Extra Care
Properties in and around Estepona's historic centre can be older, smaller or subject to planning and building considerations that do not affect a modern coastal apartment.
Layout changes, room ventilation, capacity and access arrangements are all worth checking carefully in older buildings, as is whether any works carried out over the years were properly authorised.
Buyers of older, traditional or altered properties should establish with the Town Hall whether any heritage or planning restrictions affect the building before relying on alterations, capacity or intended tourist use.
Rural and Countryside Properties Can Fall Under Different Rules
Estepona also includes inland and rural areas rising towards Sierra Bermeja.
Do not assume that every countryside villa advertised to tourists falls under exactly the same regime as a conventional VUT on urban residential land.
Depending on the property's location and characteristics, different tourism or planning categories can become relevant, including rules applying to rural tourist accommodation.
Anyone purchasing a rural property specifically for holiday-rental use should establish:
- land classification
- planning status
- lawful residential use
- tourism category
- access and infrastructure position
- whether the intended use falls within the normal VUT regime

Guest Registration Is Separate From the VUT
As elsewhere in Andalucía, an operating Estepona holiday rental is subject to the applicable national guest-information reporting regime.
These obligations operate separately from the tourism-registration and Estepona planning position.
The owner or operator should therefore have the required guest-information collection and reporting procedure in place before accepting bookings.
Buying an Estepona Property With an Existing Tourist Licence
A property marketed as having an existing tourist licence can be attractive to buyers, particularly where holiday-rental income forms part of the investment case.
But the registration number should trigger further due diligence.
Before purchasing, establish:
- whether the VUT registration genuinely relates to that property
- when the tourist activity began
- who is currently registered as the operator
- authorised guest capacity
- municipal planning status
- whether there are unresolved planning issues
- community statutes and resolutions
- community approval position
- whether the physical property corresponds with the documentation
- implications of changing owner or operator
Where holiday-rental income is essential to the purchase, these questions should ideally be resolved before entering into a binding purchase agreement.

Don't Assume the Rules Are the Same as Málaga City or Marbella
Estepona, Marbella and Málaga are separate municipalities and their local planning measures should not be confused.
Málaga city has introduced substantial municipality-specific restrictions affecting new tourist accommodation.
As of this guide's August 2026 review, we have not identified an equivalent Estepona-wide suspension from current official Estepona sources.
That position can change.
